General terms and conditions of Mi Gomera - Klaudia Stieber

§ 1 

The guest accommodation contract is deemed to be concluded when the holiday flat has been ordered by the guest and confirmed by the landlord. For the confirmation, both the written and the short-term oral form are binding. The guest accommodation contract obliges the guest and the landlord to comply with it and is only concluded between the landlord and the guest and the persons accompanying the guest. An unauthorised accommodation of further overnight guests is only permitted after prior agreement.

§ 2 

The landlord undertakes to make the holiday flat available to the guest in perfect condition in accordance with legal regulations or customary market practice. He is obliged to provide the guest with other accommodation if he is not able to provide the agreed holiday flat despite confirmation. The landlord also undertakes to let the reserved holiday flat to another tenant as soon as possible if the guest is unable to fulfil the contract and to repay the compensation paid in full or in part.

§ 3 

If the guest withdraws from the contract before the start of the stay or arrives later or departs earlier than agreed, he/she is obliged to pay the landlord the agreed rental price less the own costs saved for the days on which he/she does not use the reserved holiday flat. Payment shall be due at the latest on the day of arrival of the agreed rental period and shall be made in advance. In the event of non-utilisation of the contractual services, the guest shall be obliged to pay the agreed or customary price, less the expenses saved by the lessor. Until the accommodation is otherwise allocated, the guest shall pay the calculated amount for the duration of the contract.

§ 4 

Cancellation of the tenancy agreement

  • Cancellation by the Hirer up to 8 weeks before the beginning of the rental period is free of charge, but the deposit paid remains with the Owner. 

  • In the event of cancellation by the hirer less than 8 weeks but more than 4 weeks before the start of the hire period, 50% of the agreed hire charge shall be payable.

  • In the event of cancellation less than 4 weeks before the start of the rental period, 100% of the agreed rental price is payable.

  • It is therefore recommended to take out travel cancellation insurance.

 

§ 5 

The day of arrival is considered a rental day and will be charged as such. An overnight rate shall be agreed. On the day of arrival, the holiday flat ordered is available to the guest from 3 pm. On the day of departure, the guest must leave the holiday flat by 10 a.m. in order to give the landlord the opportunity to prepare it again for the following guest.

§ 6

The rented property shall be handed over to the tenant in a clean and contractually compliant condition. Should there be any defects or the inventory be incomplete at the time of handover, the tenant must notify the keyholder/landlord of this immediately. Otherwise, the rented property shall be deemed to have been handed over in perfect condition. If damage occurs in the flats caused by the guest, the guest shall be liable for it; the guest shall be liable for all persons accompanying him. A deposit may be required in advance to cover the costs of expected damage.

§ 7 

Personal data of the customer shall only be collected within the framework of the statutory provisions of the Federal Data Protection Act and the Teleservices Data Protection Act. They will only be made accessible to third parties to the extent that this is necessary to process the rental (cleaning service, property management, insurance, etc.).

§ 8 

Upon receipt of the booking confirmation, 100 euros must be paid as a deposit. You will receive information on payment together with the booking confirmation.

§ 9 

Utilities (such as electricity, gas, internet, etc.) are included in the rental price. Bringing dogs requires our consent. The guest is obliged to notify us in advance of the wish to bring one or more pets. If we agree to the bringing of pets, this is subject to the condition that the pets are under the constant supervision of the guest, are free of disease and do not otherwise pose a danger to the other guests.

§ 10 

The place of jurisdiction is La Gomera.

§ 11 

Severability clause: Should one or more provisions of these General Terms and Conditions become invalid, this shall not affect the validity of the remaining provisions. The invalid provision shall be replaced by a valid provision which comes as close as possible to the economic purpose pursued by the invalid provision.
